Privacy notice

Who we are
Ninth Orbit Software. Email: dan@ninthorbitsoftware.com. We decide how this information is used. Write to that address about anything on this page.
Your files
Our apps work on your own computer. Your files are not uploaded to us or anyone else. We don't sell your details.
What we collect
The periods below are for our website database, and a daily clean-up keeps to them. Each one runs from the last activity on that record. Copies in our email, such as the alerts we get for orders and quotes, aren't part of that clean-up. Ask us and we'll delete them.
Order tickets
- What
- The apps you choose, your name, email and note, the wording of the tick box and when you ticked it, plus the order status and our own notes. We never ask for card details, and we don't store your IP address here.
- Why
- To handle your order, arrange payment and keep a record of what you agreed.
- How long
- An unpaid ticket: 2 years after the last update, then deleted. A paid ticket is kept for our tax and sales records.
Licences
- What
- The name on the licence, your email, the price, how you paid and the payment reference, the licence serial, and our notes. We don't store your full licence code.
- Why
- To supply your licence, replace a lost code and keep sales records.
- How long
- Kept for our tax and sales records, and so we can look up your purchase. A refunded or switched-off licence is kept too, because the switch-off has to keep working.
Licence activation and checks
- What
- The name and code you enter (the code is sent to check it, not stored), a random ID for your PC (stored scrambled), the app version, a fingerprint of the program file, when it last checked in, and how many checks it has made. When you activate, the app also sends its trial ID, which links your trial record to your licence.
- Why
- To keep one code with one person, limit it to 3 PCs, and confirm the copy is unchanged.
- How long
- 2 years after that PC last checked in, then deleted. If it checks in later, it takes a free place on your licence again. Records of a switched-off licence are kept, because the switch-off has to keep working.
Free trials
- What
- Scrambled IDs made by a one-way hash from your PC's Windows ID, motherboard ID and Windows disk serial number, which don't reveal those IDs but are still an ID for your PC. Also the first and latest dates, how many times the app was opened, the app version, and, if you buy, the date and licence serial. If a trial is blocked, the date of the block.
- Why
- To count the trial days and stop a trial restarting on the same PC.
- How long
- This record has no 2-year limit. The scrambled IDs and dates are kept for as long as we need them to stop a trial restarting on the same PC, because deleting them would let it restart. A marker also stays on your PC after you uninstall the app.
Changed-copy reports
- What
- If an app finds its program file has changed: the scrambled PC ID, a fingerprint of the file, the app version, the dates and a count.
- Why
- To spot changed copies. We may block a changed copy.
- How long
- 2 years after the last report from that PC for that file, then deleted.
Download form
- What
- Your email, where you heard about us, the file you asked for and, if you ticked the box, when you ticked it.
- Why
- So we know who is trying our apps. We send marketing emails only to people who ticked "Email me about new apps and updates." You can stop them any time by emailing dan@ninthorbitsoftware.com.
- How long
- 2 years after you filled in the form, then deleted. Ask us and we'll remove it sooner.
Download log
- What
- Each counted installer download records the file, a keyed scramble of your IP address (the address itself isn't stored), your country, your network's name, your browser and system, the site the link was on, and a person-or-bot label. It also holds a link to your download form entry, so a log row can be tied to your email.
- Why
- To see who is really downloading, and to spot bots and abuse.
- How long
- 30 days, then deleted.
Quote form
- What
- Your name, email, business name and type, what you need, budget, timeline, the sample you liked and your message, plus the status of your request and our notes.
- Why
- To reply to your request and keep track of it.
- How long
- 2 years after the last update to your request, then deleted. Ask us and we'll remove it sooner, unless the law requires us to keep it.
Battle Nova testers
- What
- Your email, downloads, game version, feedback and phone model.
- Why
- To run the beta test.
- How long
- Sign-ups: 2 years after your last sign-up or download, then deleted. Feedback: 2 years after you sent it, then deleted. Ask us and we'll remove it sooner.
Cookies and browser storage
This site uses no analytics or advertising scripts, and the public pages set no cookies. The only cookie is the sign-in cookie for our private admin page. The Battle Nova tester pages keep your email in your browser for that session. The help chat runs in your browser, so what you type isn't sent to us.
Our legal reasons
We use order, licence and activation details to carry out our agreement with you. We use the trial check, changed-copy reports and download log for our legitimate interest in stopping misuse. We use the download form to run our trials, and we send marketing emails only because you ticked the box. We use the quote form because you asked us to reply. We keep records where the law requires it.
Who else handles your data
We use a few service providers to run the site. They may handle data outside your country.
- Cloudflare hosts this website, our database and our download files, and forwards our email. It sees your IP address when you connect.
- Our email provider holds the emails we send and receive.
- Payment providers: the wallet, bank or payment service we arrange with you handles your payment.
- Google supplies the fonts on these pages, so your browser contacts Google when a page loads. Battle Nova test files sit on Google Drive.
- Hugging Face supplies the AI models that ImageForge and MusicForge download on first run, so it sees your IP address then.
Your rights
You can ask to see, correct or delete your details, or ask us to stop contacting you. Email dan@ninthorbitsoftware.com. To be removed from our download list, email the same address.
You can also complain to the data protection authority where you live. In the Philippines, that is the National Privacy Commission.
