// THE SMALL PRINT

Terms of use

This is a plain summary. Each app comes with its own licence agreement, which you accept when you install it. That agreement has the full terms and applies to your use of the app.

Your licence

A licence works on up to 3 computers you own or control, for one person, for personal or business work. It is licensed to you, not sold. Pay once, no subscription. A licence check runs at least every 30 days, and a paid copy locks if it can't complete that check. Trials need an online check every 7 days.

You are responsible for what you make

Our apps work on your own computer. Your files are not uploaded to us or anyone else, and we do not review what you make.

You are responsible for everything you put into our apps, everything you make with them, and how you use it. Use only material you created yourself or have permission to use. Before you sell or publish your work, check that you have the rights to do so. Your work must not contain or copy anyone else's protected work, name, brand, logo, character, voice or likeness unless you have their permission.

What you must not do

You must not use our apps to:

  1. make, change or share sexual or nude images of a real person without that person's consent;
  2. make any sexual image of, or image that sexualises, a child or a person who appears to be a child, whether real or invented;
  3. imitate a real person's face, body, voice or signature to deceive anyone, or impersonate them;
  4. copy or recreate another person's song, lyrics, artwork, character or logo, or remove a watermark, copyright notice or other ownership information without permission;
  5. get around password or copy protection on a file you have no right to open;
  6. forge, falsify or alter a document or signature.

We may end your licence if you do.

AI-made work

This applies to ImageForge and MusicForge. Your work is made by AI. Copyright law may not protect some or all of it, and that differs by country. Similar output may be produced for other users. The licence of the AI model that made your work may add limits, listed in Attachment A of the licence agreement and under Third-party licences in the app. Where the law requires, you must tell people that content is AI-made, especially content that looks like real people or events.

What we don't promise

We claim no rights in what you make. As between you and us, you may use it for personal or business purposes, including selling it, as long as you follow the licence agreement. This gives you no rights in material that belongs to anyone else. We make no promise that your work is free of other people's rights, that it is unique, or that it can be protected or owned.

Refunds and switching off a licence

See our refund policy.

Your consumer rights

If you buy as a consumer, your country's law may give you rights we can't exclude, such as repair, replacement, refund or compensation. Nothing in our licence agreements or on this page removes those rights.

Governing law

Our licence agreements are governed by the laws of the country where Ninth Orbit Software is based, but that doesn't remove consumer protections that apply where you live.
